Bogdan is a bold advocate and a trusted advisor – his goal is to secure favourable results for his clients while providing the most cost-effective legal service. Prior to co-founding MBBM Lawyers, Bogdan worked for the world’s largest multinational law firm where he advised a wide range of international clients on a variety of legal matters.

Bogdan is a special advisor and a preferred defence counsel for many prominent Canadian and international insurers and corporations. He specializes in complex insurance and commercial litigation, including accident benefits, motor-vehicle tort, fraudulent claims and occupiers’ and product liability.

Bogdan has successfully represented his clients at various levels of court and administrative tribunal including the Ontario Superior Court of Justice, Ontario Provincial Offences Court, the Financial Services Commission of Ontario (FSCO), and the Licence Appeal Tribunal (LAT) as well as at numerous private arbitrations. He has written for several publications, including Ontario Insurance Adjuster’s Association (OIAA) Without Prejudice Magazine and Mondaq Canada. Bogdan regularly speaks and presents at various insurance industry events, including the Ontario Risk and Insurance Management Society (ORIMS), the Osgoode Professional Development, as well as other client seminars and lunch and learns.

On a personal note, in February 2000, Bogdan came to Canada as a war refugee from former Yugoslavia as part of the Office of the United Nations High Commissioner for Refugees sponsorship program. Since then, he’s been a proud Canadian and a volunteer for a number of charitable and not-for-profit organizations. In his free time, Bogdan enjoys spending time with his family, playing competitive chess, and exploring trails, parks, and conservation areas in this wonderful province of ours.

Cases

Economical Mutual Insurance Company: (P.F. v Economical Mutual Insurance Co.) Bogdan successfully argued an in-person arbitration hearing with Vice-Chair Lester ordering in Bogdan’s favour that the applicant is not entitled to accident benefits as the injuries sustained in the incident were not from an “accident” as defined in section 3(1) of the Statutory Accident Benefits Schedule.

Wawanesa Mutual Insurance Company: (17-001855 v Mutual Insurance Co.) Bogdan successfully argued at this accident benefits LAT hearing that the applicant (i) sustained predominately minor injuries as defined under the SABS; (ii) is not entitled to attendant care and psychological assessments; and (iii) is not entitled to costs of the arbitration.

Liberty Mutual General Insurance Company: Bogdan successfully argued that the Ontario Insurance Act and specifically s. 268 of the Insurance Act (Ontario Regulation 283/95) applies to an American insurer that does not undertake or agree or offer to undertake a contract in the Province of Ontario but that has filed a “Power of Attorney and Undertaking” (PAU).

Economical Mutual Insurance Company: Bogdan successfully argued a dismissal of an application for rescission at the Superior Court of Justice brought forth by the plaintiff. Bogdan argued this decision before the Honourable Justice J.E. Ferguson and secured $12,000.00 in costs for his client.

Wawanesa Mutual Insurance Company: Bogdan successfully argued dismissal of action as against the plaintiff at the Superior Court of Justice. Bogdan argued this decision before the Honourable Justice T.A. Bielby and secured $22,627.65 in costs for his client.

Confidential Client: Bogdan successfully argued a virtual private arbitration hearing pursuant to the Arbitration Act, 1991, relating to a contractual dispute between two institutional parties. In addition to winning the case, Bogdan was successful in obtaining substantial indemnity costs for his client with respect to this private arbitration hearing.
